Nexus

Terms of Service

These terms apply to your use of Nexus, including the website at privatechat.projectaxis.nl, the web app, the Windows app and the developer API. Please read them together with our Privacy Policy.

1. Who we are

Nexus is operated by Project Axis, based in the Netherlands ("we", "us"). You can reach us at [email protected].

By creating an account or using Nexus you agree to these terms. If you don't agree, please don't use Nexus.

2. Who can use Nexus

You must be at least 13 years old to use Nexus. We ask for your date of birth when you register and refuse accounts for people under 13.

If you are under 18, you may only use Nexus with permission from a parent or legal guardian, who should read these terms with you.

You may not use Nexus if we have previously banned your account, or if you are not allowed to use it under the law that applies to you.

3. Your account

  • Give accurate information when you register and keep your email address up to date, because we use it for security notices and password resets.
  • Keep your password secret. We recommend turning on two-factor authentication or adding a passkey in your account settings.
  • You are responsible for what happens through your account. Tell us at [email protected] if you think someone else has access to it.
  • Your username must not impersonate another person or organisation, or be offensive.

4. Your content

You keep the rights to the messages, files, images and other content you post on Nexus.

To run the service, you give us a non-exclusive, worldwide, royalty-free licence to store, copy, transmit and display your content, only as far as needed to operate, secure and improve Nexus. This licence ends when you delete the content or your account, except for copies that other users have saved or shared, and copies in backups until they are overwritten.

You are responsible for the content you post. Only post content you have the right to share.

5. Acceptable use

You may not use Nexus to:

  • break the law, or encourage others to do so;
  • harass, threaten, bully or dox other people, or promote violence or hatred against people based on who they are;
  • share sexual content involving minors, or sexual content of anyone without their consent;
  • share sexually explicit or graphic content outside channels that are marked as age-restricted;
  • spread malware, phishing links or scams, or try to get other users' passwords or payment details;
  • send spam, run unsolicited mass messaging, or artificially inflate members, reactions or other activity;
  • infringe someone else's copyright, trademark, privacy or other rights;
  • get around a ban, a block, a rate limit or any other restriction we or a server's moderators have set;
  • access or interfere with accounts, servers or systems you don't have permission for, including scanning, scraping or overloading Nexus;
  • sell, rent or transfer accounts or usernames.

If you see content or behaviour that breaks these rules, please report it with the report option in the app or by email to [email protected].

6. Servers and moderation

Anyone can create a server. The owner of a server and the moderators they appoint can set their own rules, configure AutoMod and remove content or members from their server. Those rules apply on top of these terms, not instead of them.

Server owners are responsible for running their server in line with these terms. We may act on a server as a whole if it is used mainly to break them.

7. Bots, applications and the API

You can register applications and bots in the developer portal. When you do:

  • keep bot tokens and client secrets confidential, and rotate them if they leak;
  • respect rate limits and only request the permissions and scopes your application needs;
  • tell users clearly what data your application collects and what you do with it, and don't use data from Nexus for purposes users have not agreed to;
  • don't use the API to build tools that break these terms, such as self-bots on user accounts, spam bots or scrapers.

We may limit, suspend or remove applications that break these rules or put users at risk.

9. How we enforce these terms

If content or an account breaks these terms or the law, we may remove the content, limit features, suspend the account or ban it permanently. We decide based on the seriousness of the violation and earlier violations.

When we take action against your content or account, we tell you what we did and why, unless the law prevents this or it would put others at risk. If you disagree with a decision, email [email protected] within six months. A person who was not involved in the original decision will review it, and we will let you know the outcome.

Server moderators make their own decisions within their servers. Contact them first if you disagree with a moderation decision in a specific server.

10. Availability and changes to Nexus

We work to keep Nexus available and secure, but we can't promise that it will always be available or free of errors. We may need to take it offline for maintenance.

We may add, change or remove features. If we remove a paid feature you have paid for, we will offer you a proportional refund.

11. Our rights

The Nexus name, logo, software and design belong to Project Axis. These terms don't give you any rights to them, except for the right to use Nexus as described here.

12. Liability

Nexus is provided as it is. Content on Nexus is posted by users and does not reflect our views.

As far as the law allows, we are not liable for indirect damage, such as lost profits or lost data, and our total liability is limited to the amount you paid us in the 12 months before the event, or 50 euros if that is higher.

These limits do not apply to damage caused by our intent or gross negligence, and they don't affect your rights as a consumer under mandatory law.

13. Ending your use of Nexus

You can stop using Nexus at any time. You can delete your account in your account settings. Deletion takes effect 14 days later; if you log in during those 14 days, the deletion is cancelled. Before you can delete your account, you need to transfer or delete the servers you own.

We may end or suspend your account as described in section 9. If we end your account for a reason other than a violation of these terms, we will tell you at least 30 days in advance where possible and refund any prepaid period you can no longer use.

14. Changes to these terms

We may update these terms, for example when we add features or when the law changes. We will tell you about important changes by email or in the app at least 30 days before they take effect. If you don't agree with the new terms, you can delete your account before they take effect.

15. Applicable law and disputes

Dutch law applies to these terms. If you live in another EU country, you keep the protection of the mandatory consumer law of that country.

If you have a complaint, please email us first at [email protected] so we can try to solve it together. Disputes go to the competent court in the Netherlands, unless mandatory law gives you the right to go to the court where you live.
